I often considered writing another book about franchising and was undecided whether it would be a re-write of my previous book, Franchising From the Inside Out.

I had decided upon one thing, namely, that the subject matter would be focused on some aspect of buying a franchise. After searching various sources of franchise information including Amazon.com, the Internet and other venues I found little or no information in any format that provided the right amount of detail regarding purchasing a franchise. This included whether or not buying a franchise was the right decision.

 Certain people I know who work in the franchise industry suggested that I write a book for individuals thinking of buying a franchise. Having seen the problems associated with some large fast growth franchise programs that caused numerous franchisees to lose their investment, provided further motivation to write a comprehensive manual.

 My thirty five years in the franchise industry have allowed me to see the best and worst of the franchise industry. There is no doubt in my mind that the industry needs some fixing. However, in my opinion there are only three key options:

  • More regulation of the franchise industry. I don't see this happening, although more powerful franchisee associations could provide impetus in this area, it remains to be seen.
  • Self policing by the franchise industry. Will not rid franchising of the bad operators. Although I believe the majority of franchisors are well intentioned and have a fair program, there will always be a certain number of franchisors that do the wrong thing.
  • More knowledgeable franchise candidates. For me, individuals that are better able to choose and evaluate franchises and spot potential danger signs represent the best course to follow.

Working in the franchise industry has been a rewarding and satisfying experience, however, after many years and despite seeing a huge increase in information and advice for people seeking a franchise opportunity, problems continue. For these reasons I’ve decided to provide a process and a guide for prospective franchisees to follow. People who follow the advice and utilize the tools in The Franchise Buyer's Manual should make better decisions and protect their investment.

Good News, U.S. Hotel Profit Recovery

According to the new PKF Trends survey, the U.S. lodging industry produced a 12.7% profit growth in 2011.  80.5% of participating hotels enjoyed an increase in total revenue while 72.3% achieved growth in profits.  The recently released 2012 edition of Trends presents data from a sample of nearly 7000 financial statements of United States hotels.  For the Trends report, hotel profits are defined as net operating income (NOI) before deductions for capital reserves, rent, interest, income taxes, depreciation and amortization.

 

Federal Court Invalidates "Quickie" Union Election Rule, For Now

On May 14, 2012, the U.S. District Court for the District of Columbia set aside a controversial final rule of the National Labor Relations Board ("NLRB") that was designed to make it easier and faster for unions to hold organizing elections.   Chamber of Commerce of the United States of America, et al. v. NLRB, Case No. 11-02262 (D.D.C. May 14, 2012).  Business groups are hailing the decision, but the celebration may be short lived.  Because the ruling was essentially decided on a procedural point, the NLRB may seek to resurrect the rule, which creates a very short window for union elections, and leaves employers with little time to react to an organized union campaign.
